Please read and acknowledge the following terms before using the YodocEMRâ„¢ platform.
1. HIPAA COMPLIANCE NOTICE
Dear Patient,
Health Lync LLC is the owner and operator of the Wellyfy brand and is committed to maintaining the privacy and security of your protected health information (PHI) as required by the Health Insurance Portability and Accountability Act (HIPAA). The YodocEMRâ„¢ platform has been designed with enterprise-grade security measures, including:
- Encryption of all data in transit using TLS 1.2 or higher and at rest using AES-256 encryption.
- Role-based access controls (RBAC) and multi-factor authentication (MFA) for clinical and administrative access.
- Data hosted in SOC 2 Type II-certified, HIPAA-compliant data centers within the United States.
- Continuous monitoring, intrusion detection, and regular penetration testing.
- Business Associate Agreements (BAAs) in place with all third-party service providers who handle PHI.
Please be aware of the following:
- Data Security: Health Lync LLC implements comprehensive administrative, technical, and physical safeguards to protect your PHI. While no system can guarantee absolute security, Wellyfy employs industry-standard measures that meet or exceed HIPAA Security Rule requirements.
- Third-Party Components: The YodocEMRâ„¢ platform integrates with third-party services to deliver telehealth and health monitoring features. All third-party providers are contractually bound to maintain HIPAA compliance and are subject to Wellyfy's vendor due diligence and oversight processes.
- Consent: By using the YodocEMRâ„¢ platform, you acknowledge the inherent risks of electronic data transmission and agree to the terms outlined herein.
I acknowledge that I have read and understood the above HIPAA Compliance Notice. I consent to the terms outlined above and understand the measures taken to protect my PHI on the YodocEMRâ„¢ platform.
2. FINANCIAL RESPONSIBILITY AGREEMENT
I understand and agree to the following financial terms related to my use of the YodocEMRâ„¢ platform provided by Health Lync LLC:
- Billing: I understand that I may be charged for telehealth consultations and other services provided through the YodocEMRâ„¢ platform as agreed upon with my healthcare provider. Fee schedules are made available prior to service delivery.
- Insurance: I acknowledge that it is my responsibility to verify if my insurance covers telehealth services and to provide accurate insurance information to ensure accurate billing. Wellyfy does not guarantee insurance coverage for any services.
- Payment: I agree to pay any applicable fees and charges associated with the services provided through the YodocEMRâ„¢ platform in a timely manner as agreed upon with my healthcare provider.
- Payment Processing: All payment transactions are processed through PCI DSS-compliant payment processors. Wellyfy does not store full credit card numbers on its servers.
- Refunds: Refund requests are handled on a case-by-case basis in accordance with Wellyfy's refund policy. Requests should be submitted to support@thehealthlync.com.
- Subscription Services: If applicable, subscription-based services will be billed on a recurring basis as described at the time of enrollment. Users may cancel subscriptions at any time through their account settings, with cancellation taking effect at the end of the current billing period.

3. PATIENT AGREEMENT AND ACKNOWLEDGMENT OF RISKS
I acknowledge that I have been informed and understand the following terms and conditions associated with using the YodocEMRâ„¢ platform, provided by Health Lync LLC:
- Platform Services: The YodocEMRâ„¢ platform provides telehealth consultations, health monitoring, and wellness services through a secure, HIPAA-compliant infrastructure. Health Lync LLC maintains Business Associate Agreements with all third-party service providers and conducts ongoing vendor compliance reviews.
- Data Transmission: I understand that electronic transmission of patient data, including personal and medical information, carries inherent risks. Health Lync LLC employs enterprise-grade encryption (TLS 1.2+ in transit, AES-256 at rest) and complies with HIPAA Security Rule requirements. While no system can guarantee absolute security, Wellyfy implements industry-leading safeguards to minimize risk.
- Wearable Device and Health Platform Data: If I choose to connect wearable devices or third-party health platforms (e.g., Apple Health, Google Fit, Garmin Connect, Fitbit, Samsung Health), I understand that wellness and activity data from those platforms will be imported into the Wellyfy platform solely for health tracking, telehealth support, and personalized recommendations. I may disconnect these integrations at any time through my account settings or the respective platform.
- Artificial Intelligence: I understand that Wellyfy uses AI technologies, including Gemini (Google LLC) and Claude (Anthropic PBC), to provide health insights and wellness recommendations. AI-generated information is intended for informational purposes only and does not constitute medical advice, diagnosis, or treatment. All clinical decisions are made by licensed healthcare providers.
- Telehealth Limitations: I understand that telehealth services have inherent limitations, including the inability to perform physical examinations. Telehealth is not a substitute for in-person medical care when clinically indicated, and is not appropriate for medical emergencies. In the event of a medical emergency, I should immediately contact emergency services (911).
- Limitation of Liability: To the maximum extent permitted by applicable law, Health Lync LLC's total liability for any claims arising from or related to the use of the YodocEMRâ„¢ platform shall not exceed the total fees paid by the user to Wellyfy during the twelve (12) months preceding the claim. Health Lync LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages.
- Indemnification: I agree to indemnify and hold harmless Health Lync LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from my misuse of the platform, violation of these Terms, or infringement of any third party's rights.
By clicking accept below, I acknowledge that I have read and understood the above information. I voluntarily choose to use the YodocEMRâ„¢ platform with full knowledge of the associated risks and terms.
4. MEDICAL DISCLAIMER
The information, insights, and recommendations provided through the Wellyfy platform, including those generated by artificial intelligence technologies, are intended for informational and supportive purposes only.
- Wellyfy does not provide medical diagnoses, medical treatment, or emergency medical services through automated systems.
- Health-related insights or wellness recommendations generated by the platform should not be considered a substitute for professional medical advice, diagnosis, or treatment.
- Users should always seek the advice of a licensed physician or qualified healthcare provider regarding any medical condition or treatment decisions.
- If a user believes they may be experiencing a medical emergency, they should immediately contact emergency services (911) or visit the nearest emergency medical facility.
- Healthcare decisions made through the Wellyfy platform are the responsibility of licensed healthcare providers and the patient.
- Health information collected through wearable devices, connected health platforms, or user-reported inputs may not always be accurate or complete. Users and healthcare providers should independently verify health information before making medical decisions.
5. TELEHEALTH CONSENT
By using the telehealth features of the YodocEMRâ„¢ platform, I understand and agree to the following:
- Telehealth involves the delivery of healthcare services using electronic communications, including video, audio, and messaging technologies.
- Telehealth consultations are conducted over encrypted communication channels. Video, audio, and text communications are not recorded unless I provide explicit consent prior to recording.
- I understand that telehealth has limitations, including the inability to perform hands-on physical examinations, and that my healthcare provider may determine that an in-person visit is necessary.
- I have the right to withdraw my consent for telehealth services at any time without affecting my right to receive in-person care.
- I am responsible for ensuring a private setting during telehealth sessions to protect the confidentiality of my health information.
- I understand that technical difficulties may occasionally disrupt or prevent telehealth sessions, and that Wellyfy is not liable for service interruptions caused by internet connectivity, device failures, or other factors outside its control.
6. WEARABLE DEVICE AND HEALTH PLATFORM INTEGRATIONS
If I choose to connect wearable devices or third-party health platforms to my Wellyfy account, I understand and agree to the following:
- Voluntary Connection: All wearable and health platform integrations are optional. I must explicitly authorize each connection through the respective platform's authentication process.
- Supported Platforms: Integrations may include Apple Health, Google Fit / Health Connect, Garmin Connect, Fitbit, Samsung Health, and other platforms as supported by Wellyfy.
- Data Accessed: When connected, Wellyfy may access activity metrics, heart rate data, sleep and recovery data, vital signs, and other wellness metrics I have shared through the connected platform.
- Purpose of Use: Wearable data is used solely for wellness tracking, health insights, supporting telehealth consultations, and personalized recommendations within the Wellyfy platform.
- No Sale of Data: Wellyfy does not sell, monetize, or use wearable data for advertising purposes.
- Revocation: I may disconnect any wearable integration at any time through my Wellyfy account settings or through the respective platform. Upon disconnection, associated data will be deleted or de-identified within ninety (90) days, unless retention is required by law.
- Data Accuracy: Wellyfy does not guarantee the accuracy or medical validity of data obtained from wearable devices or health platforms.
- Third-Party Responsibility: Wearable device manufacturers and health platform providers operate independently. I should review their respective privacy policies and terms of service.
7. ARTIFICIAL INTELLIGENCE SERVICES
Wellyfy incorporates artificial intelligence (AI) technologies, including Gemini (Google LLC) and Claude (Anthropic PBC), to enhance health and wellness services. By using AI-powered features, I understand and agree to the following:
- Informational Only: AI-generated insights, recommendations, and responses are intended for informational and supportive purposes only. They do not constitute medical advice, diagnosis, or treatment.
- Not a Replacement for Professional Care: AI features are designed to support — not replace — the professional judgment of licensed healthcare providers. All clinical decisions remain with qualified healthcare professionals.
- Data Processing: AI systems may process my health data (including wearable data, if connected) to provide personalized insights. All data processed by AI is subject to the same privacy and security protections described in Wellyfy's Privacy Policy.
- Anonymized Training Data: Wellyfy may use de-identified and anonymized data to train and improve AI models. Identifiable health data is never used for AI training without explicit written authorization.
- Accuracy: AI-generated outputs may not always be accurate, complete, or applicable to my individual circumstances. I should verify AI-generated information with a qualified healthcare provider.
- No Emergency Use: AI features are not designed for use in medical emergencies. In the event of a medical emergency, I should immediately contact emergency services (911).
8. ACCEPTABLE USE POLICY
By using the Wellyfy platform, I agree not to:
- Use the platform for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the platform, other user accounts, or any systems or networks connected to the platform.
- Transmit viruses, malware, or any other malicious code through the platform.
- Use the platform to transmit false, misleading, or fraudulent health information.
- Interfere with or disrupt the operation of the platform or the servers or networks used to make the platform available.
- Record, screenshot, or redistribute telehealth sessions or provider communications without explicit consent from all parties involved.
- Use the platform for any purpose other than its intended use as a health and wellness platform.
- Share account credentials with unauthorized individuals.
- Misrepresent identity, medical conditions, or insurance information.
Violation of this Acceptable Use Policy may result in suspension or termination of the user's account and access to the platform.
9. INTELLECTUAL PROPERTY
- The Wellyfy platform, YodocEMRâ„¢, and all associated content, features, trademarks, logos, and technology are the intellectual property of Health Lync LLC and are protected by applicable copyright, trademark, and other intellectual property laws.
- Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform for personal, non-commercial health and wellness purposes in accordance with these Terms.
- Users may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the platform or its content without the prior written consent of Health Lync LLC.
- User-generated content (e.g., health data, consultation notes) remains the property of the user, subject to the licenses granted herein for the purpose of providing Services.
10. ACCOUNT TERMINATION
- User-Initiated Termination: Users may terminate their account at any time by contacting support@thehealthlync.com or through their account settings. Upon termination, Wellyfy will delete or de-identify the user's personal data within ninety (90) days, except where retention is required by law (e.g., HIPAA record retention requirements).
- Wellyfy-Initiated Termination: Health Lync LLC reserves the right to suspend or terminate a user's account at any time for violation of these Terms, the Acceptable Use Policy, or the Code of Conduct, or for any conduct that Wellyfy reasonably believes is harmful to other users, healthcare providers, or the platform.
- Effect of Termination: Upon termination, the user's right to access and use the platform ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, intellectual property, and governing law) shall remain in effect.
11. Code of Conduct for Patients
1. Respect and Professionalism
- Treat all healthcare providers, staff, and other patients with courtesy and respect.
- Maintain professional communication at all times, avoiding any inappropriate, offensive, or abusive language.
2. Privacy and Confidentiality
- Safeguard the privacy of personal and medical information.
- Do not share login credentials or other sensitive data with unauthorized persons.
3. Compliance with Policies
- Adhere to all terms, conditions, and guidelines outlined by Health Lync.
- Consult only for non-emergency situations and follow the advice provided by professionals.
4. Timely Communication
- Be responsive and timely in communication with healthcare providers.
- Provide accurate and complete information as required.
5. Responsible Usage
- Use the platform only for its intended purpose, avoiding any fraudulent or misleading activities.
- Report any suspicious activities or ethical concerns to Health Lync immediately.
12. Code of Conduct for Doctors
1. Professionalism and Ethical Practice
- Provide professional and unbiased care to all patients, regardless of their background or beliefs.
- Follow accepted medical guidelines, standards, and practices.
2. Confidentiality
- Maintain the confidentiality of patient information in compliance with applicable laws.
- Ensure secure handling and storage of patient records.
3. Respect for Patient Rights
- Respect the autonomy, privacy, and dignity of patients.
- Provide clear and comprehensive information, ensuring patients' informed consent.
4. Responsiveness and Communication
- Respond to patient inquiries in a timely and professional manner.
- Communicate clearly, avoiding medical jargon when possible, and ensure patients understand their care and treatment options.
5. Compliance with Health Lync Policies
- Adhere to all rules, terms, and conditions provided by Health Lync.
- Avoid advertising, solicitation, or any unprofessional behavior on the platform.
6. Continuous Learning
- Commit to continuous professional development, staying up-to-date with the latest medical knowledge and techniques.
7. Reporting and Accountability
- Report any unprofessional or suspicious activities by patients or other doctors to Health Lync.
- Accept responsibility for the accuracy and quality of the medical advice provided.
13. DISPUTE RESOLUTION
- Informal Resolution: Before initiating any formal legal proceeding, users agree to first attempt to resolve any dispute with Wellyfy informally by contacting support@thehealthlync.com. Wellyfy will make good-faith efforts to resolve the matter within thirty (30) days.
- Binding Arbitration: If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Wellyfy platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Travis County, Texas.
- Class Action Waiver: Users agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.
- Exceptions: Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights or unauthorized disclosure of confidential information.
14. CHANGES TO THESE TERMS
Health Lync LLC reserves the right to update or modify these Terms and Conditions at any time to reflect changes in our practices, Services, legal requirements, or regulatory guidance.
- Material changes will be communicated to users via email, in-app notification, or a prominent notice on the Wellyfy platform at least thirty (30) days prior to the changes taking effect.
- Continued use of the platform after the effective date of changes constitutes acceptance of the updated Terms.
- Users who do not agree with the updated Terms may discontinue use of the Services and terminate their account.
- Previous versions of these Terms are available upon request by contacting support@thehealthlync.com.
15. GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas and applicable federal laws of the United States, including HIPAA, TDPSA, and other relevant regulations, without regard to conflict of law principles.
Any disputes not subject to arbitration shall be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Conclusion
These Terms and Conditions, together with Wellyfy's Privacy Policy, constitute the entire agreement between the user and Health Lync LLC regarding the use of the Wellyfy platform and YodocEMRâ„¢ services. This agreement supersedes all prior agreements, representations, and understandings.
These Terms are intended to foster a respectful, safe, and professional environment for both patients and healthcare providers on the Wellyfy platform. Compliance with these guidelines is expected, and failure to adhere may result in appropriate actions by Health Lync LLC, including suspension or termination of access.
